Additional Sessions Judge Amitabh Rawat dismissed the bail plea of Gurmeet Singh and stated the accused was “part of the unlawful assembly which, in prosecution of common object, had committed the offence” of rioting and firing, resulting in gunshot accidents to some folks and police officers.
“Regarding the role of the present accused/applicant Gurmeet Singh, he is clearly visible in the CCTV footage in an aggressive posture with other rioters. He is holding wooden ‘fatta’ (plank) and brick in his hands. Thus, he is actively participating in the riots. “Thus, the accused was half of the illegal meeting which in prosecution of widespread object had dedicated the offence of rioting and firing gunshot accidents on the general public individuals and police officers and thus, each member of illegal meeting is deemed to be responsible of offence dedicated by each member of that meeting in prosecution of widespread object of that meeting, the courtroom stated in its order handed on December 18.
During the listening to, Singh’s counsel claimed he had been falsely implicated in the matter and was pulling a rickshaw with a passenger throughout the riots in the Welcome space. Special Public Prosecutor Saleem Ahmed, showing for the police, opposed the bail plea, saying Singh may be clearly seen in a CCTV footage allegedly actively taking part in the riots and pelting stones.
Communal violence had damaged out in northeast Delhi on February 24 after clashes between these opposing the amended citizenship regulation and people supporting it spiralled out of management, leaving a minimum of 53 folks useless and round 200 injured.
