New Delhi:
The National Green Tribunal has rapped the Ministry of Environment and Forests (MoEF) over compliance of situations talked about in environmental clearances granted for initiatives, saying the mechanism for monitoring environmental norms is insufficient.
The inexperienced panel stated compliance of situations of environmental clearance have to be monitored on periodical foundation, not less than as soon as in 1 / 4.
A bench headed by NGT Chairperson Justice AK Goel stated there may be poor monitoring and there are large gaps in laying down of situations and its enforcement.
It requested the Environment Ministry to overview and strengthen the mechanism for the aim.
The tribunal took be aware of an affidavit filed by the ministry which talked about that there are particular proposals to strengthen the monitoring mechanism.
The NGT stated that this solely reveals insensitivity to the important constitutional obligation regardless of repeated instructions.
“Repeated plea of merely having such proposals, without effective enforcement on the ground can hardly be held to be satisfactory. Counsel for the MoEF states that there has been further meaningful steps, after filing of the affidavit but the same could not brought on record.”
“We cannot accept such a statement. If steps have been actually taken, we fail to understand why the same could not be produced atleast during the hearing. We record our dissatisfaction at the attitude of the MoEF on the subject,” the bench stated.
It directed the ministry to take efficient steps to discharge its constitutional obligation to advance “Precautionary” and “Sustainable Development” rules and in addition the “Public Trust Doctrine”.
“We need not repeat the observations with regard to the acknowledged deficiencies in the existing mechanism which urgently needs to be remedied. Let affidavit of compliance be filed before the next date by e-mail,” the bench stated.
The matter is listed for listening to on December 17.
The instructions got here when the inexperienced panel was listening to a plea moved by petitioner Sandeep Mittal in search of stricter mechanisms to make sure compliance of situations talked about in environmental clearances granted for initiatives.
Laying down situations for EC primarily based on appraisal will not be sufficient until compliance thereof is duly monitored and ensured with a view to attain the stated object, the plea stated.
