A Non-Resident Indian who lives in Canada has filed a ‘habeas corpus’ petition within the Gujarat High Court, alleging that his spouse’s dad and mom are usually not permitting her to return to him.
On Wednesday, Justice Sonia Gokani ordered that the lady, whose dad and mom stay in Gujarat’s Mehasana district, shall be produced earlier than the excessive court docket on August 5 via video convention from the closest district court docket.

Petitioner Giriraj Chouhan, who hails from Rajasthan, stated he and his spouse Ankita Chaudhari met in Canada the place each had migrated for jobs, and married in Ontario on January 26, 2018.
When his spouse visited her dad and mom in Mehsana in Gujarat in May 2020, they didn’t permit her to return to Canada and even refused to permit him to fulfill her, the petition alleged.
He feared that her life could possibly be at risk, he stated.
A habeas corpus (“produce the body”) petition is filed when an individual is alleged to be illegally detained, or goes lacking.
“Let the corpus (the woman) be brought before this Court on the returnable date, to be presented before us through video conference to be arranged at the nearest district court in presence of the presiding officer,” the excessive court docket stated.
